User Agreement

This User Agreement (hereinafter — "Agreement") governs the relationship between the owner of the Fix Price VPN service (hereinafter — "Company") and the user (hereinafter — "User") when using the VPN service (hereinafter — "Service").
1. General Provisions
- By using the Fix Price VPN Service, the User confirms their agreement with the terms of this Agreement.
- The Company reserves the right to make changes to the Agreement without prior notice to the User.
- Continued use of the Service after changes means acceptance of the new terms.
- This Agreement is an integral part of the Public Offer Agreement and Privacy Policy. In case of contradictions, the Offer terms apply; the Policy applies to personal data processing matters.
2. Services and Their Use
- Fix Price VPN provides VPN services, including secure encrypted connection and traffic routing for personal lawful purposes. The Service is not intended for illegal circumvention of restrictions and does not guarantee anonymity.
- The Service may provide additional free services (restriction bypass methods, special protocols, optimizations) that are not included in the paid tariff. Due to actions of government authorities, internet providers, technical limitations, or regulatory requirements, such services may be changed or disabled at any time without notice or compensation.
- The User agrees to use the Service in accordance with applicable law and not to violate the rights of third parties.
- It is prohibited to use the Service for distributing malware, spam, and other illegal activities.
3. Registration and Security
- Access to full Service functionality may require registration.
- The User is responsible for the security of their credentials and access keys.
- The Company is not responsible for consequences of unauthorized access to the User's account.
4. Payment and Tariffs
- Services are provided on a paid basis according to the selected tariff.
- All payments are made through reliable payment systems.
- Refunds are possible in accordance with the refund policy. The service is considered provided when access to VPN servers and secure connection capability is ensured; changes or discontinuation of experimental features do not constitute grounds for refund.
- Refunds are only possible if the service has not been actually used. If traffic of 1 MB or more has been used, the service is considered provided and no refund will be issued. Payment system and bank fees are non-refundable.
- If auto-renewal is provided for the selected tariff, the User can cancel it before the next billing period through the Telegram bot.
- Refunds are processed in accordance with the Refund Policy and the Public Offer Agreement terms.
5. Liability of Parties
- The Company makes reasonable efforts to maintain Service operability; availability depends on third parties (data centers, internet providers, payment and messenger platforms). Brief interruptions caused by maintenance, accidents, traffic/protocol blocking, actions/inactions of third parties and/or regulatory requirements are permissible and are not considered failure to provide services.
- The User is responsible for compliance with the laws of their country/region when using the Service and for the content of transmitted/received data.
- The Company is not liable for inability to use the Service for reasons beyond its control, including failures on the provider side, restrictive measures by government authorities and platform owners.
6. Confidentiality
- The Company undertakes not to disclose User's personal data, except as required by law.
- Details of personal data processing are set out in the Privacy Policy.
7. Age Restrictions and Resale Prohibition
- The Service is not intended for persons under 16 years of age. By using the Service, the User confirms they are at least 16 years old; otherwise, use of the Service is prohibited.
- It is prohibited to resell, transfer, lease, publish, or otherwise provide third parties with access to the account, keys, configurations, or QR codes. Use is permitted only for personal purposes within the selected tariff.
8. Acceptable Use Policy (AUP)
- The User agrees to comply with applicable laws of their country/region and is responsible for the content of transmitted and received data.
- It is prohibited to use the Service for: spam distribution, DDoS attacks, port scanning, password cracking, malware distribution; copyright and other rights violations; distribution of extremist, terrorist, pornographic, and other prohibited materials; bypassing technical protection measures and access restrictions where prohibited by applicable law; cryptocurrency mining without approval.
- Creating abnormally high load on Service infrastructure is prohibited. If anomalous traffic is detected, the Service may limit or terminate services without refund.
- It is prohibited to transfer/resell access, keys, configurations, and QR codes to third parties; sharing beyond the selected tariff is not permitted.
9. Suspension and Termination of Services
- The Company may, without prior notice, suspend or limit services, and if necessary, terminate access in cases of: (a) violation of this Agreement, Section 8 (AUP), or legislation; (b) transfer/resale of access to third parties; (c) late payment; (d) detection or reasonable suspicion of fraud, actions causing harm to Company or third-party infrastructure; (e) initiation of chargeback procedure; (f) receipt of mandatory requirements from rights holders, providers, regulators, court, or law enforcement.
- Payments for the suspension/blocking period under the above grounds are non-refundable.
10. Force Majeure
- The Parties are released from liability for partial or complete non-fulfillment of obligations under the Agreement if such non-fulfillment is caused by force majeure circumstances that the Parties could not foresee or prevent (including but not limited to: electrical and communication network failures, mass Internet failures, DDoS attacks, government actions, provider and platform owner blocks, strikes, natural disasters, military actions, emergencies).
- A Party for whom performance has become impossible must notify the other Party within a reasonable time; the term of obligations is extended for the duration of such circumstances and their consequences.
11. Third-Party Blocking and Restrictions
- The Service is not responsible for restrictions, blocking, filtering, and other actions by government authorities, internet providers, data centers, and other third parties.
- The User acknowledges that such restrictions may fully or partially prevent Service operation.
- Nevertheless, the Service makes reasonable efforts to maintain paid services for as long as technically possible.
- The Service does not guarantee bypass of blocks or permanent availability of IP addresses and servers.
12. Dispute Resolution and Final Provisions
- The Parties establish a mandatory pre-trial (claim) dispute resolution procedure: claims are sent to support contacts, response time is 10 (ten) calendar days.
- This Agreement is governed by the law of the Russian Federation. All disputes are subject to consideration in courts at the Company's place of registration, unless otherwise provided by mandatory consumer protection legislation.
- If any provision of the Agreement is found invalid, this does not affect the validity of other provisions.
